1px;">顾名思义，就是超过法定退休年龄的劳动者。其中既有退休返聘的技术骨干、行业专家，也有从事保安、家政等工作的基层劳动者。依法提前退休的劳动者也纳入超龄劳动者权益保障的对象之中。需要说明的是，弹性延迟退休期间存在劳动关系的劳动者，有劳动合同法、《事业单位人事管理条例》等法律法规保护，不在暂行规定适用范围。</span></p><p style="line-height: 1;"><span 1px;">当前，我国超过法定退休年龄仍在就业的劳动者众多，劳动权益面临法律保障不足的问题。发布暂行规定，就是要填补现行劳动法律制度的短板，明确用人单位与超龄劳动者的权利和义务，保障超过法定退休年龄劳动者的合法权益。</span></p><p style="line-height: 1;"><span leaf=""><br/></span></p><p style="line-height: style="font-size: 16px;letter-spacing: 1px;">“根据暂行规定要求，用人单位应对超龄劳动者能够胜任的岗位不设置不合理的年龄限制，同时充分考虑超龄劳动者身心状态，不在可能危害超龄劳动者身心健康的岗位上招用超龄劳动者。”中国劳动和社会保障科学研究院研究员李文静说，用人单位也应及时与超龄劳动者订立书面用工协议，落实各项权益的保障义务。</span></p><p 1px;">暂行规定明确，需延长缴费的超龄劳动者，可以个人身份继续缴纳养老保险费；经与用人单位协商一致，用人单位也可为其缴纳养老保险费，个人应当缴纳的养老保险费由用人单位代扣代缴。</span></p><p style="line-height: 1;"><span leaf=""><br/></span></p><p style="line-height: 2;"><span
